These Terms of Service govern your use of the Virtuality website and your purchase of products through our online store.

By accessing the website or placing an order, you agree to comply with these Terms of Service, subject to your rights under applicable South African law.

1. DEFINITIONS

In these Terms:

"Virtuality", "we", "us" or "our" means the Virtuality business operating this website.

"Customer", "you" or "your" means any person who accesses the website or purchases products from Virtuality.

"Products" means merchandise offered for sale through the Virtuality website.

"Website" means the Virtuality online store and associated webpages.

2. ELIGIBILITY

By placing an order, you confirm that:

  • The information you provide is accurate and complete;

  • You have the legal capacity to enter into the transaction; and

  • You will comply with these Terms and applicable law.

3. PRODUCTS

Virtuality reserves the right to:

  • Change product specifications;

  • Discontinue products;

Where an order has already been accepted and payment received, Virtuality will comply with its legal obligations regarding the transaction.

4. PRICING

All prices displayed on the website are stated in South African Rand unless otherwise indicated.

Virtuality reserves the right to change prices at any time before an order is accepted.

Where an obvious pricing or listing error occurs, Virtuality may take appropriate steps permitted by applicable law.

5. ORDERS

Placing an order constitutes an offer by the customer to purchase the selected products.

An automated order confirmation confirms receipt of the order request and does not necessarily constitute final acceptance where further verification is reasonably required.

Virtuality may refuse or cancel an order where permitted by law, including where:

  • A product is unavailable;

  • There is an obvious pricing or listing error;

  • Payment cannot be verified;

  • Fraud or unauthorised activity is reasonably suspected; or

  • The transaction cannot reasonably be fulfilled.

Where payment has already been received and Virtuality is unable to fulfil the order, the applicable refund or other remedy will be provided in accordance with applicable law.

6. PAYMENT

Payments may be processed through third-party payment providers made available through the website.

Virtuality does not ordinarily have access to customers' complete card credentials where payment is processed by an independent payment provider.

Customers must provide accurate billing and payment information.

7. ELECTRONIC TRANSACTIONS

Virtuality operates an online store and electronic transactions are subject to applicable South African electronic-commerce legislation, including the Electronic Communications and Transactions Act 25 of 2002.

The ECT Act establishes requirements concerning electronic transactions and consumer information, including certain cancellation rights in specified circumstances.

Nothing in these Terms is intended to remove a statutory right that cannot lawfully be removed.

8. RETURNS AND REFUNDS

All returns and refunds are governed by the Virtuality Return & Refund Policy, which forms part of these Terms.

Unless required by law, Virtuality does not provide refunds merely because a customer changes their mind.

Size exchanges may be available subject to the Return & Refund Policy.

Statutory rights relating to defective, unsafe or non-conforming goods remain unaffected.

9. SHIPPING

All deliveries are governed by the Virtuality Shipping Policy, which forms part of these Terms.

Delivery dates and times are estimates unless expressly stated otherwise.

10. CUSTOMER INFORMATION

Customers are responsible for ensuring that information submitted during checkout is accurate.

This includes:

  • Full name;

  • Delivery address;

  • Email address;

  • Telephone number; and

  • Payment information.

Virtuality may contact customers regarding orders, deliveries, returns, exchanges or other matters reasonably connected with a transaction.

11. WEBSITE USE

You agree not to:

  • Use the website for unlawful purposes;

  • Attempt to gain unauthorised access to website systems;

  • Interfere with website functionality;

  • Introduce malicious code or software;

  • Scrape or reproduce website content for unauthorised commercial purposes;

All Virtuality branding, designs, photographs, videos, graphics, text and other original content are protected by applicable intellectual-property laws.

13. USER CONTENT

If you submit reviews, photographs, comments, testimonials or other content to Virtuality, you confirm that you have the right to provide that content.

You grant Virtuality permission to use such content for legitimate business, marketing and promotional purposes, subject to applicable law and any separate agreement governing the submission.

14. THIRD-PARTY SERVICES

The website may rely on third-party providers for services including:

  • Payments;

  • Hosting;

  • Analytics;

This clause does not remove any mandatory rights or remedies available to consumers under applicable law.

22. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the extent necessary to make it lawful where possible.

The remaining provisions will continue to apply.

23. ENTIRE AGREEMENT

These Terms, together with the applicable Virtuality policies and any additional terms presented during checkout, constitute the terms governing your use of the website and purchase of Virtuality products, subject to applicable law.
